Part 4
Use of Common Areas and Common Facilities

There shall be no obstruction of the Common Areas or facilities nor shall anything be stored in the Common Areas or facilities without the prior written consent of the Trustees, except as hereinafter expressly provided. In the event that such approval is granted, storage shall be at the sole risk of the person storing the materials.

Nothing shall be hung from the windows, decks or placed upon the windowsills, nor may any rugs or mops be shaken or hung on any windows, doors, or decks. No clothes, sheets, blankets, laundry or any other kind of articles shall be hung out of a Unit or exposed on the Common Areas or common facilities of the Condominium. No accumulation of rubbish, debris or unsightly materials will be permitted in the Common Areas.

Other than chairs, benches and tables of such number, nature, and of such type as are actively used for residential purposes, no other goods, materials, fixtures or paraphernalia, are to be affixed, placed or stored on decks, patios, driveways, except with the approval of the Trustees.

The Condominium Trust may charge to a Unit Owner any damage to the mechanical, electrical, or other building service systems or any damage to the common elements caused by such Unit Owner or by his family, his tenants, servants, employees or visitors by their willful or negligent use, misuse or abuse of those systems or elements. The reasonable cost of the work to repair such damage shall constitute a lien upon such unit and the Unit Owner shall be personally liable therefor.

Use of the conservation land will comply with city and state approved restrictions.

  1. Definition of Common Areas

    1. Land: Subject to any restrictions and easements, all property and improvements erected there on deeded with the Condominium. It is the responsibility of the Association to maintain all walks, stairs, drives, landscaping, exterior rails, fencing, etc., comprising the site improvements. Areas of maintenance include, but are not limited to; landscape maintenance, pool and tennis court maintenance, snow removal, periodic painting, general site lighting and conservation land management.
    2. Buildings: The Association is responsible for the exterior maintenance of all components of these buildings beyond the limits of the individual units described in this manual. House numbers have been attached to the front of all units. No other house numbers are to be attached to the front, rear, or sides of the unit.
    3. Areas of maintenance to these buildings include, but are not limited to exterior clapboards, trim, and roofs. On-grade patios, fences and as well as decks and privacy fences are common areas to which the adjacent unit has exclusive use; however, the fences are maintained by the Association whereas the patios and decks are the owners responsibility. Each unit owner is responsible for keeping their deck or patio in a good state of preservation and cleanliness.

    4. Mechanical and Electrical Services: The Association is responsible for maintenance of all components of the Mechanical and Electrical distribution systems providing service up to the limits of individual units. These systems include main water, irrigation systems, sanitary and storm sewer, sewer monitoring equipment and holding tanks and electrical distribution systems.

  2. Snow Procedures

    The Trust contractor is responsible for clearing and treating all main roadways, parking areas, driveways and walkways. The snow removal contractor under contract with Quail Run is ELDCO, Inc. of Winchester. The contract requires that ELDCO provide snow removal and sanding services throughout the season. The contractor agrees that in the event of a snow or weather emergency, they will keep all main roadways open; then, the driveways and sidewalks will be cleared and/or sanded.

    ELDCO tries to alternate the starting point for plowing of the driveways and sidewalks through the property however this is not always possible. Please do not ask the plow operators to interrupt the process and clear your driveway or walk. If there is a medical emergency, please contact APT and a message will be dispatched to the contractor.

    Your assistance is appreciated during this process. When you hear the equipment on the property please make sure your vehicle is in the garage or moved to a cleared area. Please clear any snow from your vehicle before the area is plowed.

  3. Barbecue Grills

    The City of Woburn does not permit gas grills or barbecues, using flammable fluid as a starter, to be used on wooden decks or balconies. On the ground level they must be at least ten feet from any wooden structure. Grills with propane tanks attached, and unattached tanks, empty or with contents, cannot be stored indoors, in garages or in carports. Please use caution and common sense.

  4. Firewood Storage

    Firewood may be stored for use outside the unit. It must be placed at least 10 inches from the building, garage walls, or carport walls, should not be placed in direct contact with the ground (earth) or block ease of entry to the unit.

  5. Solicitation

    No person, including unit owners, shall enter the complex for the purpose of vending, peddling, or soliciting from residents. A notice is posted at the mailbox to inform those who do solicit. Please take notice if you are approached. Inform the person that their intent is not allowed on the property and the police will be notified of their interference. Do call Police if necessary.

  6. Trash and Hazardous Waste Removal

    Each Cluster has areas for garbage and refuse disposal. Residents are responsible for placing securely packaged garbage or refuse in their totes located in the trash structures within each Cluster. Garbage or refuse must not be left outside the totes without being firmly packaged so animals can not litter the area and to control odors. Please do not leave Trash scattered outside the barrels in paper bags, as this certainly will attract animals.

    • Trash pick up is once per week, on Tuesdays.
    • Boxes MUST be broken down and tied and placed into the bins.
    • Disposal of Large objects (i.e. hot water heaters, appliances, carpet/flooring, construction materials, cabinets, furniture, mattresses, etc.) is the responsibility of the homeowner. Please contact Waste Management at (781) 933-2113 to arrange for pick-up. Any costs associated with this pick-up will be borne by the Unit Owner.
    • Again, all bags containing household waste MUST be securely tied and deposited into the green bins. No bags may be left outside of the bins.
    • NO hazardous waste materials may be placed in or around the green bins. Items include, but not limited to, paint, household cleaners, propane tanks, flammable products, etc.. Again, a separate pick-up of these items must be arranged by the Unit Owner.
  7. Pets

    No animals, birds or other pets shall be kept in or about the Units or the Common Areas without the written consent of the Board of Trustees, and consent so given may be revoked at any time. Pets shall be licensed and inoculated as required by law. Pets shall be leashed or carried at all times in the Common Areas.

    Pet owners shall clean up after their pets if any excrement happens to collect in any of the Common Areas, including the sidewalk, garage and entry circle. No animals of any size, which in the Trustees' judgment creates unreasonable interference with use, and enjoyment of Units and Common Areas, shall be kept in any Unit or brought to Common Areas.
